American way of ecology, by Hervé Kempf
The United States took a turning point on April 2, through the voice of the Supreme Court: by affirming that the Environmental Protection Agency (EPA) has all the legitimacy to regulate the carbon dioxide emissions of automobiles, the most US high court has lifted the lock on the fight against climate change. In the triangle of powers which frames the American political system, the constitutional authority has therefore tipped the scourge of the balance against the president - who refuses to limit emissions - but in favor of Congress - who paws impatience for to embark on this path. In practice, the Court sets in motion a logic which will lead to greenhouse gas (GHG) reduction devices. The Environment Agency is certainly not obliged to regulate, but it will almost certainly be challenged in court - and will lose - if it does not.
