Since a few hours, the NSA no longer has the right to collect mass telephone data on the US territory. To better understand this case, it is necessary to trace the course of events a little earlier. Since last May 31, the 215 section of the Patriot Act has come to an end. This forced the NSA to disconnect on that date its servers responsible for collecting the metadata of citizens' phone calls.

Immediately, a meeting was convened in Congress to agree on the renewal or deletion of this section of the Patriot Act. Unable to agree on the renewal of this section that had expired, the senators had to leave the drawer the project of the USA Freedom Act which aims to restrict the powers of government agencies in terms of the means used for surveillance citizens.

Since the USA Freedom Act has been validated instead of renewing the 215 section of the Patriot Act, the NSA no longer has the right to collect citizens' phone metadata since the end of this section. By enacting the USA Freedom Act, the power to collect telephone metadata has been transferred to telecom operators. So that the NSA can access this information, it must produce an authorization issued by the FISC (Foreign Intelligence Surveillance Court), which will rule in advance on the requests of this agency according to very well defined criteria.

However, in order not to take short the telecommunication operators, a period of six months had been set in order to allow the operators to equip themselves with the appropriate infrastructures to ensure this collection.

The six months have passed since a few hours, the NSA has given the relay of data collection to operators since this morning 29 November 4 h 59 GMT.

This transfer of burden, although taxed minimal by some, shows that things are progressing in terms of privacy. It should be remembered that this result is a direct result of Edward Snowden's revelations of the NSA's espionage practices.

This greatly tainted user confidence with companies that shared their information with US government agencies. And to restore this confidence and strengthen the protection of privacy data, companies and organizations have put pressure on the US government which has led to this new situation.

The metadata that has been collected by the NSA over the past five years will be held until 29 next February, the Obama administration said. After this date, these data will be purged once pending litigation.

For Ned Price, spokesman for the National Security Council, "the law has found a reasonable compromise that allows us to continue to protect the country by implementing various reforms." However, some Republican lawmakers want to keep the mass data collection model done by the NSA up to 2017.
