I wonder what they are going to do to me .... Because I refuse to present the passat to Mamita for the update so that she no longer cheats ... They guarantee me in writing the maintenance of reliability, performance and driving pleasure ... Volkswagen: can we refuse to update the rigged software?


A year after the Volkswagen scandal, a French motorist refuses to correct the rigged software on his vehicle, on the pretext that the performance of his engine is likely to decrease. An approach that is not without risks.

The "dieselgate" continues to stir. Accused of having equipped its diesel models with software capable of misleading the authorities' anti-pollution measures tests, Volkswagen must now recall its vehicles. The correction of the cheat software is however far from being unanimous within the customers: a French motorist indeed refuses to see his car repatriated to the German manufacturer, reports Le Parisien, this Monday.

"If Volkswagen makes the correction on my Tiguan, the performance of my engine will decrease," says Roland Lacroix at Le Figaro. "However I spent nearly 48.000 euros for this model". Believing that the German manufacturer is responsible for the “hidden defects” of the vehicle, the septuagenarian therefore refuses to sign the famous authorization to return his vehicle to the garage. Contacted by Le Figaro, Volkswagen France ensures that the update "has absolutely no consequence on the vehicle's performance in terms of performance, consumption, emission, noise, etc.". A showdown still seems to have been engaged between the two parties. So much so that the dealer threatens to withdraw the manufacturer's warranty if it performs maintenance operations in another garage, says Roland Lacroix. Volkswagen France denies these claims. An investigation must be carried out by the Departmental Directorate for the Protection of Populations (DDPP) of Ain.
Concerns at technical control

In fact, nothing obliges the customer to accept the update of the rigged software. "There is no legal constraint at the moment," says Marie-Stella de Jesus, legal manager at the Automobile Club Association. "In this case, the position of the mechanic seems to be a relationship problem." Although there is no obligation for the motorist, the manufacturer can still choose to have him sign a waiver. He thus exempts himself from any responsibility in the event of a problem. A normal procedure, since it is carried out for "all other recall actions", indicates the German manufacturer to Le Figaro.

By choosing not to update his vehicle, and by refusing to sign the release, the user is nevertheless exposed to risks. "If the car no longer meets the anti-pollution standards, the user risks having problems with the technical inspection", explains Marie-Stella de Jesus. "If he does not comply and he is then checked by the authorities, his vehicle will be immobilized at the pound, or in a garage, until it meets the standards". Consequences to which we must add a fine of 90 euros.

5.4l / 100 km measured at the pump from my home Courcay 37310 France at Mont Dore, some trips on 3 days back to Courcay. 5 adults on board plus trunk of the full station wagon up to the roof always as fast as possible 854 km performed on the weekend 46.2 liters of fuel. It was for an outing with my sports club so full made at the start and at the return ...

Passat SW 140TDI fap of 2010 gearbox 6 mechanical no totaling more than 340 000km fully stock .. Tires of 215 / xx / 16 clim in automatic mode. 136 on highway 93 on national all done at 95% at speed ....

Classic consumption noted over the first three years by my brother who used this car as a taxi especially for repatriations ... Except that it was rare for him to be at 5 inside .... And above all ... Much faster on highway ...

And even with the use that my wife makes of it (mainly short trips) we have never climbed 7l / 100km ...

How much do they roll .de with that ??? Because it can also make a difference ... This car can hang the 210 counter .... But not in France ...

We are in the Californian desert, near the small town of Victorville, on the edge of the Southern California logistics airport. Seen from the sky, one could think of a huge field of solar panels - there are several nearby in this arid region. In reality, there are thousands of almost new Volkswagen vehicles, stored there for months.

The German group has bought 350 000 in total since the revelations of 2016, at a cost of more than 7,4 billion dollars. More than a thousand employees have been assigned to this unprecedented buy-back / repackaging operation in 37 car parks spread across the United States. Some of these almost new vehicles will be destroyed, others will be brought up to anti-pollution standards before having a second life.

Volkswagen may have provisioned 21 billion euros to settle the Dieselgate deal, but it has posted excellent commercial results in 2017. This episode of car cemeteries in the American desert is therefore only a tiny episode on the scale of the overpowered German group ...

completely silly to destroy these cars in very good condition.

each car has a gray energy of the order of 100 000 km ... the destruction / reconditioning still consumes more energy ... all this for ecological reasons? : Shock:

Especially in the land of 4X4 V8 petrol ...

After Volkswagen, another prestigious German manufacturer is splashed by Dieselgate. This time, it is not far from 800 000 Mercedes which are recalled in Europe by the German Ministry of Transport. And as with Volkswagen, it is the level of polluting emissions that is at issue.


These 774 000 vehicles, Vito vans and SUVs, could be equipped with software capable of distorting emission levels during tests. Clearly, cars would pass for more green than they are.

Mercedes and its parent company Daimler have so far been caught in the rain of scandal and suspicion that has rocked the industry. The group was the subject of an investigation by the Stuttgart prosecutor's office, but the engine sped up last month when the government took over the file.

Daimler, who has always disputed any manipulation, confirms this recall, but says he wants to clarify legal questions. The German Minister of Transport goes a little further: he maintains that during his meeting with the boss of Daimler, Dieter Zetsche promised to remove "the systems of measures" rejected by the authorities.

Mercedes is not the only manufacturer in the viewfinder. Audi was ordered to recall 60 000 vehicles last week. And now the CEO of the Volkswagen group brand is personally suspected of fraud.

A new blow to the German automobile giant: since the start of the 2015 scandal, Volkswagen has already spent more than 25 billion euros in fines, redemptions and compensation.

Dieselgate: Volkswagen fined one billion euros in Germany

Volkswagen announced Wednesday that it had been fined one billion euros by the Brunswick prosecutor's office as part of the investigation into the pollutant emissions from its diesel engines.

Germany fine follows January deal by 2017, US automaker, when it agreed to pay 4,3 billion (3,6 billion) in penalties to end investigations civil and criminal.

"Volkswagen accepts the fine and will not appeal," the German group said in a statement.

"In doing so, Volkswagen admits its responsibility for the diesel crisis and sees it as a major step forward in overcoming it."

The investigation of the prosecution of Brunswick established that the group marketed worldwide, between 2007 and 2015, 10,7 millions of vehicles equipped with software with an illicit function allowing to falsify the results of anti-pollution tests.

The fine ends the regulatory proceedings against Volkswagen and the manufacturer from Wolfsburg said it expects that this outcome will facilitate the conclusion of other administrative proceedings that target him in Europe.

"In doing so, Volkswagen is taking responsibility for the diesel crisis," the new chairman of the board of directors Herbert Diess repeated in a statement issued shortly after.

"New measures are needed to restore confidence in the company and the automotive industry," he added.

Volkswagen will communicate on the impact of the fine for its annual earnings forecasts when its second quarter accounts are released.
