The text of Christian Jacob (UMP) which originally made consensus, then aroused criticism of the opposition after a modification of article 2. The first version of the text in fact provided for the outright repeal of permits granted at the end of March 2010 by Jean-Louis Borloo, then Minister of Ecology.
The bill now proposes that "holders of exclusive exploration permits for liquid or gaseous hydrocarbon mines" will have two months to declare the technique used. The permits will then be revoked, only if "the holders of the permit use the technique known as hydraulic fracturing of the rock" or if they have not replied.
"The text does not hold from a legal point of view, article 2 can be challenged before the courts", underlined the socialist deputy Pascal Terrasse. During the discussion of the text on Tuesday, Jean-Marc Ayrault, leader of the socialist group had estimated that the text was strewn with "ambiguities" opening "the opportunity for license holders to pass through the cracks of the 'repeal".
The opposition also criticized article 4 of the text authorizing an experimental program in compliance with the law. "It is nevertheless necessary to foresee as of now that such a program will aim only for scientific research", specifies the text.
The adopted text also provides for the annual submission of a report from the government to Parliament on the development of techniques and the application of prison terms and fines in the event of drilling followed by hydraulic fracturing of the rock without have declared it to the administrative authority.
